Terms of Service

1. Acceptance of Terms

By accessing the Botrite Observe website or any Lattiq API endpoint, you agree to be bound by these Terms of Service. If you are using an API key, your continued use of that key constitutes acceptance. You may not use the Service if you do not agree to these Terms.

2. Description of Services

Lattiq, LLC ("Lattiq," "we," "us," or "our") provides Botrite Observe (the "Service"): an API that accepts a URL, fetches the publicly accessible content at that URL, hashes it, compares that hash against the most recent prior observation, and returns:

• A changed boolean indicating whether the content differs from the last observation
• A content hash of the current fetch
• A timestamp of the observation
• An Observation Receipt — an Ed25519-signed token recording the above fields

The Service is provided via the endpoint POST https://api.lattiq.ai/v1/observe. We may add, modify, or remove features with reasonable notice.

3. No Warranty / No Reliance

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. LATTIQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

All outputs from the Service, including change detection results, content hashes, timestamps, and Observation Receipts, are provided for informational purposes only. You are solely responsible for any decisions made in reliance on Service outputs. Lattiq has no obligation to update or correct any output after it is generated.

The Service fetches URLs as a standard HTTP client. We make no representation that a fetched response is identical to what a human user would see in a browser (JavaScript rendering, cookies, personalization, and CDN edge caches may produce different results).

4. Limitation of Liability

IN NO EVENT SHALL LATTIQ LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LATTIQ LLC'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) TEN DOLLARS ($10.00).

5. Acceptable Use Policy

You agree not to use the Service to:

• Check URLs you are not authorized to access, or attempt to bypass authentication or access controls
• Harass, stalk, or surveil individuals — including monitoring personal social profiles or private pages without the subject's consent
• Generate excessive request volume intended to degrade service availability (denial-of-service or stress testing)
• Check URLs containing, distributing, or linking to illegal content (CSAM, malware, fraud schemes)
• Use the Service as the sole basis for automated safety-critical, financial, or legal decisions without independent verification
• Resell or redistribute Service outputs as a competing data product without written permission from Lattiq

Lattiq reserves the right to block specific URLs, rate-limit or terminate access for any account found in violation of these restrictions, without prior notice.

6. Observation Receipts — Scope and Limitations

An Observation Receipt is an Ed25519-signed record of Lattiq's observation at a specific URL and timestamp. What it records:

• The URL submitted
• The UTC timestamp of the fetch
• A SHA-256 hash of the HTTP response body received by our servers
• Whether that hash differs from the prior observation hash for the same URL

What an Observation Receipt is not:

• A legal notarization, certification, or attestation under any jurisdiction
• Evidence of what content was visible to a specific user or browser at any time
• A guarantee of the accuracy, completeness, or authenticity of the content at the URL
• Admissible evidence in any legal, regulatory, or compliance proceeding without independent verification

If you redistribute an Observation Receipt as part of your own product or service, you must display the following disclaimer in a reasonably visible manner: "This observation receipt was generated by Botrite Observe. It records a hash of an HTTP response and does not constitute a legal proof, certification, or guarantee of content accuracy."

7. Data Processing

When you submit a URL to the Service, we:

• Fetch the URL via an outbound HTTP request from our servers
• Compute and store a hash of the response body
• Store the URL, timestamp, hash, and observation metadata in our database
• Do not permanently store the raw HTML or content of the response

We store your API key (hashed), request logs, and usage metadata for billing, security, and abuse prevention purposes. We do not sell your data to third parties. See our Privacy Policy for full details.

8. Payment Terms

The Service includes a free tier of 5 checks per day. Additional checks are available as prepaid check packs purchased via Stripe. All purchases are non-refundable except where required by applicable law.

Check packs expire twelve (12) months from the date of purchase. Unused checks have no cash value. Lattiq reserves the right to change pricing with thirty (30) days notice via website posting or API response headers. Continued use of the Service after a price change constitutes acceptance of the new pricing.

9. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes not resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Wyoming or via video conference. You waive any right to bring a class action or representative proceeding.

Either party may seek relief in small claims court for disputes within that court's jurisdiction.
